The man must be the biological father. Section 1(2) of the Family Law Reform Act 1987 includes in the meaning of s 2(1) children legitimated by statute. This enables a child’s father to gain parental responsibility if he subsequently marries the child’s mother. A married man has no parental responsibility for children who are not biologically his own, even if they are born during the marriage. Children born to a married couple as a result of artificial insemination will, however, be regarded as the child of the husband provided that the conditions set out in the Human Fertilisation and Embryology Act 1990 are met.

1 Application Emergency protection orders may be sought by any person. Usually, the applicant is an ‘authorised officer’ of the local authority, or ‘a designated officer’ of the police. The application should be made in the family proceedings court, unless the local authority has been directed to investigate under s 37, or there are proceedings pending in another court. In these exceptional cases the application can be made in the relevant court, Children (Allocation of Proceedings) Order 1991, Art 3.

In these, the court establishes who are parties to, or who should have notice of, the proceedings. The court ensures that the evidence is in order and service is carried out. A timetable is set for preparation and disclosure of evidence to other parties and the guardian ad litem, and a hearing date fixed. Directions given carry the force of court orders, failure to comply with them will be viewed by the court seriously and a full explanation for non-compliance will be required. Sanctions include wasted costs orders against those parties to a case who cause (or negligently allow) unnecessary delay.
