That generally accepted principle was reflected in a rule known as the Fairness Doctrine. The opinion of the District of Columbia Court of Appeals took note of the commission’s intention to undercut the Fairness Doctrine: “Here, however, the Commission itself has already largely undermined the legitimacy of its own rule. The FCC has issued a formal report that eviscerates the rationale for its regulations. The agency has deliberately cast grave legal doubt on the fairness doctrine. . ” The court was essentially compelled to send the case back to the FCC for further proceedings, and the commission used that opportunity to repeal the Fairness Doctrine.
